Welcome to Miracle on 22nd Street, Inc. (“Miracle,” “we,” “our,” or “us”). By accessing or using our website at www.miracleon22ndstreet.com (the “Website”) or participating in any Miracle-related activity (including as a donor, volunteer, or family participant), you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully.
If you do not agree with any part of these Terms, please refrain from using the Website or participating in the program.

1. Our Mission

Miracle on 22nd Street is a 501(c)(3) nonprofit that helps families in need by connecting them with volunteers (“Elves”) who adopt holiday letters and send gifts directly to families. We operate with love, care, and community at our core — but we’re also a volunteer-run program, and participation is subject to the limitations outlined below.

2. Eligibility

  • Families submitting letters must reside in the U.S. and have children under the age of 18.
  • Elves must be at least 18 years old and agree to use submitted family information respectfully and privately.
  • All users must submit truthful and accurate information.

3. Use of the Website

The Website is for personal, non-commercial use only. You may not use the Website to:

  • Harass, threaten, or impersonate others
  • Interfere with other users’ experience
  • Access or attempt to access information not intended for you
  • Distribute spam, malware, or harmful content
  • Violate any applicable laws or these Terms

4. Program Participation Terms

For Families:

  • Not all letters can be matched with an Elf; participation does not guarantee a gift.
  • Families should only submit one letter per household per year.
  • If your information is incomplete, ineligible, or false, we may remove you from the program.

For Elves:

  • If you adopt a letter, you agree to make a best effort to send a thoughtful, timely gift.
  • You may not share, sell, or misuse the family’s information in any way.
  • If you cannot fulfill a letter you claimed, you must let us know promptly at miracleon22ndstreet@gmail.com so we can reassign it.

5. Privacy

Your use of the Website is governed by our Privacy Policy, which explains what personal information we collect, how we use it, and your rights. By using the Website, you consent to the collection and handling of your information as described therein.

6. Donations

All donations are voluntary and non-refundable. Donations may be made through third-party services like Causevox, and you are subject to their terms when doing so. Miracle does not collect or store payment information directly.

7. Third Parties

We may collaborate with other organizations, such as NYC Together and law enforcement partners, to deliver our services. These partners are expected to honor the privacy and mission of Miracle, but we are not responsible for their independent actions or policies.

Our Website may also contain links to other websites. We are not responsible for the content or policies of those third parties.

8. Intellectual Property

All content on the Website — including logos, text, graphics, and images — is owned by or licensed to Miracle and may not be copied, reproduced, or used without written permission.

9. Limitation of Liability

We are a volunteer-based nonprofit and do our best to run a smooth and compassionate program. However, we do not guarantee:

  • That every letter will be matched or fulfilled
  • That gifts will arrive on time or at all
  • That all content submitted by users is truthful or appropriate

To the fullest extent permitted by law, Miracle shall not be held liable for any damages arising out of participation in the program or use of the Website.

10. Termination

We reserve the right to suspend or terminate your access to the Website or program at our discretion, especially if we suspect any abuse, fraud, or harmful behavior.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we’ll post them to this page with the updated date. Continued use of the Website after such changes means you agree to the new Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to its conflict of laws principles.
